BAJWA TERMS OF USE

1. About These Terms
Welcome to Bajwa.
These Terms of Use govern your access to and use of the Bajwa website, mobile applications, related platforms, features, tools and services collectively referred to as the “Platform”.
The Platform is operated by Bajwa Enterprise a business registered under the laws of Ghana. In these Terms, the words “Bajwa,” “We,” “Us,” and “Our,” refer to the operator of the Platform.
By accessing, registering for or using Bajwa, you confirm that you have read, understood and agreed to these Terms.
Where you do not agree to these Terms, you must not access or use the Platform.
2. Definitions
For the purposes of these Terms:
“Account” means a registered Bajwa user profile.
“Advertiser” means a person or organisation that purchases or receives an advertising placement on Bajwa.
“Buyer” means a User who views a Listing, contacts a Seller, negotiates a transaction or purchases an item or service advertised through the Platform.
“Content” means text, photographs, images, graphics, usernames, reviews, reports, descriptions, messages, links and other material submitted, uploaded, transmitted or displayed through the Platform.
“Listing” means an advertisement, offer or publication submitted by a Seller for an item or service.
“Policies” means the policies, guidelines and notices published by Bajwa and incorporated into these Terms.
“Seller” means a User who creates, submits or publishes a Listing.
“Services” means the features, functionality and services made available through Bajwa.
“User,” “you” and “your” mean any person who accesses or uses the Platform.
“Verification” means any process used by Bajwa to confirm an email address, phone number, age, identity, business claim, ownership claim or other information.
3. Eligibility
You must be at least 18 years old to create an Account or use Bajwa.
By registering for or using the Platform, you represent and warrant that:
- you are at least 18 years old;
- you have the legal capacity to enter into a binding agreement;
- you are not prohibited by law from using the Platform; and
- you are not prohibited by law from using the Platform; and
- you will comply with these Terms and all applicable laws
Bajwa currently relies primarily on User declarations, email verification and phone-number verification. These processes do not constitute full identity verification.
We may request documents or other information to confirm your eligibility, identity or claims. Failure to provide reasonably requested information may result in restrictions, suspension or termination of your Account
4. Creating and Managing an Account
To create an Account, you may be required to provide:
- your first name;
- your last name;
- a valid email address;
- a valid phone number;
- a password; and
- any additional information reasonably required to operate or protect the Platform.
You must provide truthful, current and accurate information.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- preventing unauthorised access to your Account;
- all activity conducted through your Account;
- keeping your information reasonably up to date; and
- notifying Bajwa promptly when you suspect unauthorised access or misuse.
You must not:
- create an Account using false information;
- impersonate another person or organisation;
- create an Account for someone without their permission;
- sell, transfer, rent or assign your Account;
- use another User's Account without permission;
- create Accounts to evade enforcement measures; or
- use automated methods to create Accounts.
Bajwa may restrict the number of Accounts that may be created or operated by one person, device, phone number, email address, network or organisation.
5. Email and Phone Verification
Certain features require email-address and phone-number verification.
A User may be required to verify both their email address and phone number before they can:
- submit or publish a Listing;
- access another User's contact details;
- use certain communication features;
- submit reviews;
- access trust-related features; or
- perform other restricted actions.
Users who have not completed the required Verification may have limited access to Platform features.
Verification only confirms control of the relevant email address or phone number at the time of Verification. It does not guarantee a user's identity, honesty, trustworthiness, business status or authority to sell any item.
6. Personal Names, Business Names and Display Names
Bajwa allows individuals and businesses to use the Platform through the same general type of User Account.
A User may use a personal name, business name or trading name as permitted by the Platform. However, the use of a business or trading name does not mean that Bajwa has:
- verified the business;
- confirmed its registration;
- approved its activities;
- endorsed its products;
- confirmed its relationship with another brand; or
- granted it verified-store status.
You must not use a name, description, logo or statement that falsely suggests that you are:
- another person or organisation;
- an official representative of a brand;
- an authorised dealer, agent, distributor or partner;
- affiliated with a manufacturer or rights holder; or
- endorsed or verified by Bajwa.
A legally registered business or trading name may be used, but it must not be presented in a manner that is materially misleading.
We may request documents or information to confirm:
- identity;
- business registration;
- ownership of a business name;
- authority to represent an organisation;
- official partnership or dealership status;
- ownership or authorised use of a trademark; or
- any other claim made through an Account or Listing.
Where a name or claim may mislead Users, Bajwa may require clarification, disclaimers, supporting documents or a change of name. We may also restrict Content or take enforcement action.
7. Bajwa’s Role as a Marketplace
Bajwa provides technology that enables Buyers and Sellers to discover each other and communicate about potential transactions.
Unless Bajwa expressly states otherwise for a particular service:
- Bajwa does not own the items listed by Users;
- Bajwa does not manufacture, inspect or test listed items;
- Bajwa is not the Seller or Buyer in User transactions;
- Bajwa is not a party to agreements between Buyers and Sellers;
- Bajwa does not collect or hold purchase payments between Users;
- Bajwa does not determine the final transaction price;
- Bajwa does not arrange delivery;
- Bajwa does not provide product warranties; and
- Bajwa does not guarantee that a transaction will be completed.
Transactions are negotiated and completed directly between Buyers and Sellers.
Transactions are negotiated and completed directly between Buyers and Sellers. Bajwa does not guarantee:
- the identity of a User;
- the accuracy or completeness of a Listing;
- the existence, ownership or condition of an item;
- the legality of an item or transaction;
- the ability of a Seller to sell;
- the ability of a Buyer to pay;
- the authenticity of an item;
- the reliability of a User;
- the suitability of an item for a particular purpose; or
- that a User will fulfil an agreement.
Moderation, approval, Verification, reviews, reports or other Platform processes must not be interpreted as certification, endorsement or a guarantee by Bajwa.
8. User Transactions
Buyers and Sellers are solely responsible for deciding whether to enter into a transaction.
Before completing a transaction, Users should independently confirm:
- the identity and contact details of the other party;
- the item's ownership, condition and authenticity;
- whether the item may legally be bought or sold;
- the full price and any additional costs;
- payment arrangements;
- delivery or collection arrangements;
- applicable warranties;
- return, refund or exchange terms; and
- any documentation required by law.
Sellers must provide Buyers with any information required by applicable law, including accurate information about the Seller, item, price, payment, delivery, warranties, returns and refunds where applicable.
Any agreement formed between Users is separate from Bajwa. Users are responsible for maintaining records of their transaction where necessary.
9. Buying Safely
Bajwa encourages Users to exercise caution when communicating with or meeting other Users.
When buying through Bajwa, you should:
- avoid sending money before seeing and inspecting the item;
- be cautious of requests for deposits or advance payments;
- meet in a safe, public and well-populated location;
- tell a trusted person where you are going;
- inspect and test the item before payment;
- confirm that documents, serial numbers and ownership details are genuine;
- be cautious of prices that appear unusually low;
- avoid suspicious links or requests for confidential information; and
- stop the transaction and submit a report when something feels unsafe or dishonest.
These recommendations reduce risk but cannot eliminate it. Each User remains responsible for their own decisions and personal safety.
10. Selling Safely and Lawfully
Sellers must:
- have the legal right and authority to offer the item;
- provide an accurate title and description;
- disclose known defects or important limitations;
- use the correct category and subcategory;
- provide genuine and relevant photographs;
- state the price and material conditions clearly;
- respond honestly to reasonable Buyer questions;
- comply with applicable laws and regulations;
- avoid requesting unsafe or suspicious payment arrangements; and
- remove or deactivate Listings that are no longer available.
A Seller must not claim ownership, authenticity, authorisation, warranties or product characteristics that they cannot reasonably support.
Sellers remain responsible for all legally required consumer information, receipts, warranties, returns, exchanges, refunds, taxes, licences and regulatory obligations associated with their transactions.
11. Creating Listings
Only eligible and appropriately verified Users may submit Listings.
Each Listing must include all information required by the Platform. This may include:
- a clear title;
- an accurate description;
- the correct category and subcategory;
- a price;
- a location;
- relevant item details; and
- at least one photograph.
Bajwa may set minimum and maximum requirements for photographs, text, categories and other Listing fields. At the time of publication of these Terms, Bajwa may permit a maximum of five photographs per Listing, but this limit may be changed through the Platform without amending these Terms.
Listings must relate to items or services permitted within the categories made available by Bajwa.
The availability of a category does not automatically mean that every item falling within that category is lawful or permitted. Sellers must independently ensure compliance with applicable law and Bajwa’s Policies.
12. Listing Moderation
Every Listing may be reviewed before publication.
Bajwa may:
- approve a Listing;
- reject a Listing;
- return a Listing to the Seller for correction;
- request additional information;
- place a Listing on hold;
- change or recommend a category;
- correct obvious formatting or administrative errors;
- restrict the Listing's visibility; or
- refer the Listing for enhanced review.
Where a category change would require materially different information, Bajwa may require the Seller to edit and resubmit the Listing.
Approval only means that the Listing has passed the level of review applied by Bajwa at that time. Approval does not mean that Bajwa has:
- verified the Seller's identity;
- inspected the item;
- confirmed ownership;
- confirmed authenticity;
- confirmed legal compliance;
- certified quality or safety;
- approved the price; or
- endorsed the transaction.
Bajwa may review, restrict or remove Content after publication, even where it was previously approved.
13. Listing Lifecycle
To keep the Platform current and reduce inactive Listings, Bajwa may operate a Listing lifecycle.
A Listing may pass through stages including:
- draft;
- submitted for review;
- pending correction;
- approved;
- active;
- inactive;
- eligible for reactivation;
- archived; and
- permanently deleted.
Bajwa may periodically require Sellers to confirm that a Listing remains available.
Where a Seller does not reactivate or confirm a Listing within the period specified through the Platform:
- the Listing may become inactive;
- the Listing may stop appearing publicly;
- the Listing may remain temporarily recoverable;
- the Listing may be archived; and
- the Listing and associated media may eventually be permanently deleted.
The exact time spent at each lifecycle stage may be adjusted to improve the Platform. Where practical, Bajwa may provide notices or prompts before permanent deletion, but we do not guarantee that notice will always be provided.
Sellers are responsible for maintaining their own copies of important Listing Content.
14. Licence to Use Your Content
You retain any ownership rights you have in Content submitted to Bajwa.
By submitting Content, you grant Bajwa a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to:
- host;
- store;
- reproduce;
- process;
- resize;
- compress;
- format;
- adapt for technical purposes;
- display;
- distribute;
- communicate;
- moderate; and
- make the Content available through the Platform.
This licence is limited to operating, securing, maintaining, improving and promoting Bajwa and its Services.
For example, Bajwa may resize a Listing image, display it in search results or use a publicly available Listing to promote the availability of products on the Platform.
You represent and warrant that:
- you own the Content or have permission to use it;
- the Content does not infringe another person's rights;
- you have obtained any necessary consent from people shown in the Content; and
- Bajwa's permitted use of the Content will not violate applicable law.
The licence ends when the Content is deleted from active systems, except where:
- copies remain in backups for a limited period;
- retention is required for legal, security or enforcement purposes;
- the Content has been shared with others through normal Platform functions; or
- continued retention is otherwise permitted by law.
15. Prohibited Listings and Activities
You must not use Bajwa to advertise, promote, request, arrange or conduct any activity that is unlawful, fraudulent, harmful or prohibited by our Policies.
Prohibited Content and activities include:
- illegal goods or services;
- stolen goods;
- counterfeit products;
- fraudulent schemes;
- false or materially misleading Listings;
- items the Seller has no authority to sell;
- Content that infringes copyright, trademark or other rights;
- impersonation;
- false claims of brand affiliation;
- harassment, threats, hate speech or abusive conduct;
- spam or repetitive deceptive Listings;
- phishing or requests for login credentials;
- malware, malicious files or harmful links;
- attempts to bypass moderation, restrictions or Verification;
- manipulation of reviews, reports, rankings or Platform activity;
- scraping or unauthorised automated access;
- attempts to disrupt the Platform;
- collection of User information without permission;
- privacy violations;
- duplicate Accounts or Listings used deceptively;
- transactions intended to evade legal or regulatory obligations; and
- any other Content or conduct prohibited by the Acceptable Use Policy.
Bajwa may add, remove or update categories of restricted Content as legal, safety and operational requirements change.
16. Intellectual Property and Brand Rights
You must respect copyright, trademark, design, patent, trade-name and other intellectual property rights.
You may use photographs, logos, descriptions and other Content only where you own them or have permission to use them.
You must not:
- copy another Seller's photographs or descriptions without permission;
- use protected logos in a misleading manner;
- offer counterfeit goods;
- falsely claim that goods are genuine;
- falsely claim to be an authorised dealer;
- suggest official affiliation without evidence; or
- use another person's intellectual property unlawfully.
Rights holders may submit complaints under Bajwa's Copyright and Intellectual Property Policy.
Bajwa may remove or restrict allegedly infringing Content, request supporting evidence and take action against repeat infringers.
Submitting false, malicious or abusive intellectual property complaints is prohibited.
17. Reviews and Ratings
Where review or rating features are available, reviews must be based on genuine interactions or transaction experiences.
Reviews must not:
- contain false information;
- be submitted in exchange for improper benefits;
- be used to threaten or extort another User;
- contain harassment, hate speech or irrelevant abuse;
- disclose private information;
- impersonate another person;
- manipulate a User's rating; or
- violate applicable law or Bajwa's Policies.
Reviews represent the opinions of Users. They are not statements, endorsements or verification by Bajwa.
Bajwa may use reviews, reports, moderation history and other trust signals internally when:
- identifying suspicious activity;
- prioritising investigations;
- determining enforcement actions;
- improving search or recommendation systems; and
- protecting Users.
Bajwa may remove or restrict reviews that violate these Terms.
18. Reporting Listings, Users and Other Concerns
Users may report:
- a particular Listing;
- a Seller or Buyer;
- suspected fraud;
- misleading information;
- counterfeit goods;
- prohibited items;
- harassment;
- intellectual property concerns;
- suspicious links;
- privacy violations; or
- other policy violations.
A report may be submitted using the reporting feature available on a Listing or User profile. Bajwa may also provide a general reporting form through the Trust and Safety Centre.
Reports should include sufficient details for Bajwa to assess the concern. This may include:
- the Listing reference;
- the User involved;
- the nature of the complaint;
- relevant dates;
- screenshots;
- documents;
- communication records; and
- other supporting information.
A report does not automatically result in removal, suspension or a finding against the reported User.
Bajwa may:
- investigate the report;
- request additional information;
- contact the reported User;
- preserve relevant records;
- restrict Content temporarily;
- take enforcement action;
- refer the issue to a specialist process; or
- close the report without action.
You must submit reports honestly and in good faith. False, malicious, repetitive or abusive reports may result in enforcement action.
19. Buyer and Seller Disputes
Bajwa is not responsible for resolving private contractual disputes between Buyers and Sellers.
Where a dispute arises, Users should first attempt to resolve the matter directly, calmly and lawfully.
Bajwa may, at its discretion:
- provide reporting tools;
- review whether a User violated Platform Policies;
- preserve available records;
- remove Content;
- restrict or suspend an Account;
- provide general safety information; or
- cooperate with lawful requests from competent authorities.
Bajwa does not guarantee:
- a refund;
- replacement of an item;
- recovery of money;
- enforcement of a warranty;
- return of property;
- compensation for loss; or
- a particular outcome.
A decision by Bajwa concerning an Account or Listing is a Platform-enforcement decision. It is not a judicial determination of the legal rights of the Buyer or Seller.
Nothing in these Terms prevents a User from seeking assistance from law enforcement, a regulator, a court or another competent body.
20. Enforcement
Bajwa may take action where we reasonably believe that:
- these Terms or another Policy have been violated;
- Content may be illegal or harmful;
- a User may pose a risk to others;
- an Account has been compromised;
- fraud or manipulation may be occurring;
- information provided is false;
- Verification is required;
- action is necessary to protect the Platform; or
- action is required by law or a competent authority.
Enforcement actions may include:
- requesting information;
- issuing guidance or a warning;
- returning a Listing for correction;
- reducing a Listing's visibility;
- removing Content;
- disabling particular features;
- limiting contact-information access;
- temporarily restricting an Account;
- suspending an Account;
- cancelling an advertising campaign;
- permanently terminating an Account;
- preventing the creation of replacement Accounts; or
- referring the matter to a competent authority.
The action taken may depend on:
- the seriousness of the conduct;
- the risk to Users;
- whether the conduct was intentional;
- the User's history;
- whether the violation can be corrected;
- cooperation with the investigation; and
- legal or security requirements.
Where the risk is serious, Bajwa may act without prior notice.
Failure by Bajwa to take action in one case does not prevent us from taking action in the same or another case later.
21. Appeals
Where available, a User may request a review of a moderation or enforcement decision.
An appeal must:
- be submitted through the designated channel;
- identify the affected Account, Listing or decision;
- explain why the User believes the decision was incorrect; and
- include relevant supporting information.
Bajwa may reject appeals that are:
- incomplete;
- repetitive;
- abusive;
- fraudulent;
- submitted outside an applicable review period; or
- unrelated to the decision.
Submitting an appeal does not automatically pause enforcement or guarantee reinstatement.
Bajwa’s decision following an internal review may be treated as final, subject to applicable law.
22. Account Suspension and Termination
Bajwa may suspend or terminate an Account in accordance with these Terms.
During a suspension, the User may lose access to:
- Listings;
- contact information;
- communication features;
- reviews;
- Account settings;
- advertising services; or
- other Platform functions.
Following termination:
- public Listings may be removed;
- the User may lose access to their Account;
- associated Content may be deleted;
- the User may be prohibited from creating another Account; and
- some information may be retained for legal, security, fraud-prevention, audit or enforcement purposes.
A User may request Account deletion through the available Account controls or by contacting Bajwa.
Deletion requests are subject to the Privacy Policy and applicable law. Some information may be retained where reasonably necessary to:
- comply with law;
- respond to disputes;
- detect or prevent fraud;
- enforce these Terms;
- protect Users;
- maintain audit records; or
- establish, exercise or defend legal claims.
23. Privacy
Bajwa collects and processes personal information as described in the Privacy Policy.
This may include:
- registration information;
- contact information;
- Verification records;
- Listing Content;
- reviews and reports;
- technical information;
- IP addresses;
- device and browser information;
- usage data; and
- support communications.
Bajwa may use third-party providers for services such as:
- hosting;
- media processing;
- email delivery;
- SMS delivery;
- analytics;
- security;
- error monitoring; and
- infrastructure.
You should not upload private, confidential or sensitive material as Listing images. Listing images are intended for public display and may be processed by external media-service providers.
24. Third-Party Services and Links
The Platform may contain links to websites, services or resources operated by third parties.
Bajwa does not control and is not responsible for:
- third-party content;
- availability;
- security;
- privacy practices;
- products;
- services;
- promises; or
- transactions.
When you leave Bajwa, the third party’s terms and privacy practices apply.
You should independently assess third-party websites before providing information, making a payment or entering into an agreement.
25. Advertising
Bajwa may display third-party advertisements, banners and sponsored Content.
Advertisements will be reviewed before activation where reasonably practicable. However, an advertisement does not mean that Bajwa:
- endorses the Advertiser;
- guarantees the Advertiser;
- recommends the advertised product;
- verifies all claims;
- guarantees the destination website; or
- accepts responsibility for a transaction with the Advertiser.
Bajwa does not provide Advertisers with Users’ personal information merely because their advertisement appears on the Platform.
Advertisers may receive aggregated or campaign-level information such as:
- advertisement impressions;
- advertisement clicks; and
- general performance statistics.
An Advertiser must comply with Bajwa’s Advertising Policy.
Advertisements must use the final destination URL submitted for review. URL-shortening services or links that conceal the true destination may be rejected.
The destination page and its material purpose must remain consistent throughout the campaign. Advertisers must not redirect an approved URL to illegal, misleading, unsafe or materially different Content.
Bajwa may inspect or recheck destination links while an advertisement is active.
Where an Advertiser changes, conceals or redirects an approved destination in breach of the Advertising Policy, Bajwa may immediately:
- suspend the advertisement;
- terminate the campaign;
- restrict the Advertiser;
- refuse future campaigns; and
- deny a refund to the extent permitted by law and the applicable advertising agreement.
Advertising placement does not influence Listing moderation or enforcement decisions.
26. Platform Availability and Changes
Bajwa may change, update, test, suspend or discontinue any part of the Platform.
We do not guarantee that:
- the Platform will always be available;
- every feature will remain unchanged;
- Content will always be preserved;
- every error will be corrected immediately;
- the Platform will work with every device; or
- access will be uninterrupted.
We may perform maintenance, introduce new features, change technical requirements or restrict access for operational, legal or security reasons.
Where reasonably practicable, we may provide notice of significant changes. However, urgent security or legal changes may be made without notice.
27. User Feedback
Where you provide suggestions, comments or feedback about Bajwa, you grant us permission to use that feedback without restriction or compensation.
This does not transfer ownership of your existing intellectual property or confidential business information.
You should not submit information that you are not authorised to disclose.
28. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Bajwa and the Services are provided on an“as is” and“as available”basis.
Bajwa does not make any warranty or representation that:
- the Platform will meet every User's requirements;
- the Platform will be uninterrupted or error-free;
- Listings will be accurate;
- Users will be trustworthy;
- items will be safe, lawful or authentic;
- transactions will be successful;
- disputes will be resolved;
- Content will always remain available; or
- every harmful User or Listing will be detected.
Nothing in these Terms excludes any warranty, right or remedy that cannot lawfully be excluded.
29. Limitation of Liability
To the fullest extent permitted by applicable law, Bajwa will not be liable for losses arising from:
- transactions between Users;
- advance payments made to Users;
- inaccurate or fraudulent Listings;
- defective, unsafe, stolen or counterfeit goods;
- a User's acts or omissions;
- failure to complete a transaction;
- unauthorised Account access caused by a User's failure to secure credentials;
- third-party websites or services;
- deletion or loss of Content;
- temporary Platform unavailability;
- indirect, incidental, special or consequential loss;
- loss of profits, opportunities, goodwill or data; or
- events beyond Bajwa's reasonable control.
Where Bajwa is found legally liable and applicable law permits a contractual limitation, Bajwa’s total liability relating to the Services will be limited to the amount you paid directly to Bajwa for the particular Service giving rise to the claim during the six months before the event.
This limitation does not apply where liability cannot lawfully be limited or excluded, including liability arising from fraud or other matters protected by applicable law.
30. Indemnity
To the extent permitted by law, you agree to indemnify and hold Bajwa, its owners, officers, employees, contractors and representatives harmless from claims, losses, liabilities, penalties and reasonable costs arising from:
- your Content;
- your Listings;
- your transactions;
- your violation of these Terms;
- your violation of applicable law;
- your infringement of another person's rights;
- your misuse of the Platform; or
- false statements or claims made by you.
Bajwa will take reasonable steps to notify you of a relevant claim and may control the defence or settlement of the matter.
31. Cooperation With Authorities
Bajwa may preserve or disclose information where reasonably necessary and legally permitted to:
- comply with a court order;
- respond to a lawful request;
- cooperate with law enforcement or regulators;
- investigate suspected fraud or crime;
- prevent threats to safety;
- protect Bajwa's rights; or
- establish, exercise or defend legal claims.
Any disclosure of personal information will be handled in accordance with applicable law and the Privacy Policy.
32. Electronic Communications
By using Bajwa, you agree that notices and communications may be provided electronically, including through:
- email;
- SMS;
- in-platform notifications;
- Account messages;
- banners; or
- publication through the Platform.
You are responsible for maintaining access to your registered email address and phone number.
A communication will generally be treated as received when sent to your registered contact details or made available through your Account, subject to applicable law.
Marketing communications will be handled separately from essential service, legal, security and Account communications. Where required, you may unsubscribe from marketing communications.
33. Changes to These Terms
Bajwa may update these Terms to reflect:
- changes to the Platform;
- new features;
- legal or regulatory requirements;
- security developments;
- changes to our business operations; or
- improvements to clarity.
The updated Terms will display a revised “Last updated” date.
Where a change is material, Bajwa may provide additional notice through the Platform, email or another reasonable method.
Your continued use of Bajwa after updated Terms take effect means you agree to the updated Terms.
Where you do not agree to an update, you must stop using the Platform and may request Account deletion.
34. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Ghana.
Users should first submit Platform-related complaints through Bajwa’s designated complaints process.
Where a dispute cannot be resolved informally, it may be submitted to a court or other competent dispute-resolution body in Ghana, subject to any mandatory rights or procedures under applicable law.
Nothing in these Terms prevents Bajwa or a User from seeking urgent legal relief where necessary to protect safety, confidential information, intellectual property or Platform security.
35. General Provisions
35.1 Entire Agreement
These Terms and the Policies incorporated into them form the entire agreement between you and Bajwa concerning your use of the Platform.
35.2 Severability
Where a provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or removed. The remaining provisions will continue in effect.
35.3 No Waiver
Failure or delay by Bajwa in enforcing a provision does not waive our right to enforce it later.
35.4 Assignment
You may not transfer your rights or obligations under these Terms without Bajwa's written consent.
Bajwa may transfer its rights and obligations as part of a restructuring, merger, acquisition, sale or transfer of the Platform, subject to applicable law.
35.5 No Partnership or Agency
These Terms do not create an employment, partnership, joint venture, franchise or agency relationship between Bajwa and any User.
35.6 Headings
Section headings are provided for convenience and do not affect interpretation.
35.7 Language
These Terms are written in English. Where a translation is provided, the English version will prevail to the extent permitted by law, unless Bajwa expressly states otherwise.
35.8 Survival
Provisions concerning intellectual property, Content licences, enforcement, liability, indemnity, disputes and any provisions intended by their nature to continue will survive Account closure or termination.
